论行政执法责任制的完善——以长沙市为视角

On the Perfection of the System of Administrative Responsibility——By the View of Changsha

行政执法责任制是指为规范行政执法活动,明确行政执法主体及其行政执法人员在行政执法活动中的责任和义务,并对不履行或违法履行行政执法责任的行为进行行政追究的法律制度。湖南省在90年代初推行行政执法责任制,长沙市在制度建设及实行方面走在全省前列,也取得了一定成效,但与这项工作开展得较好的兄弟省市相比,还存在着差距。完善行政执法责任制,是转变政府职能、优化经济发展环境的客观要求,也是构建和谐社会的必然要求。应根据“责任政府理论”、“平衡理论”、“行政职责本位论”,完善行政执法责任制。

Responsibility system of administrative execution refers to the legal system which is made to normalize activitiea of administrative execution, to nail down the main body of administration and the responsibilities and obligations of its members while they are doing their work and to went behind their legal responsibilities of these people who not filfill or illegally fulfill their responsibilities of administrative execution. At the begin：aing of 1990＇s, Hunan province started to carry out the responsibility system of administrative execution. And, in our province, Changsha is among the most successful cities on building this system and carl.wing it out. Also, accomplishments in this area have been made. While, compared with other provinces and cities which perform quite well in this aspect, Hunan province still has a lot to do. It＇s the object requilcments of transforming the governmental performance, of optimizing the economic development emvironment, and of building a peaceful and harmonious society to put this system into full practice and perfect it. We should follow the requests of ＂the responsibility-taking government theory＂, ＂the equilibrium theory＂ and ＂the basis theory of administrative responsibility＂ to consummate the responsibility system of administrative execution.
