中药是中华民族优秀的文化宝库的重要内容之一。21世纪,中医药业在“回归自然”的浪潮中,获得发展的机遇,同时也面临着严峻的挑战。知识产权保护乏力,已经成为中医药产业发展的瓶颈之一。本文拟从对中药专利保护的优劣进行比较分析,并针对专利保护的不足之处提出对策。

Traditional Chinese medicine is one of the most important contents in Chinese excellent culture resources. In the 21certury, the industry of Chinese medicine ＆medical science will face the chance of development as well as sever challenge in the trend of ＂return to nature＂. The lack of intellectual property protection servers as one of the bottleneck in the development of the Chinese medicine ＆ medical industry. This paper intends to compare and analysis the advantage and disadvantage of Chinese traditional medicine patent protection in order to find the solution to the deficiency of protection.
