法的精神是法律制度的灵魂,它决定着法的价值取向、法的基本原则,是法学研究中的核心问题之一。在我国完善社会主义市场经济法律体系的背景下,探讨和研究法的基本精神具有十分重要的意义。文章在研究中国传统法的基本精神和西方法的基本精神以及中西法的精神比较的基础上,进一步探讨了社会主义市场经济条件下法的基本精神。

The spirit of law＇ the soul of the legal system,which determines the value orientation of law and the basic principle of law, is one of the focus problem on the research of law. Under the background of＂ perfecting the legal system of socialism market economy in our country, discussing and researching the basic spirit of law have very important significance. On the foundation of researching the basic spirit of Chinese traditional law and the basic spirit of the Western law and comparing the spirit of Chinese law with the spirit of the Western law, this article further discusses the spirit of law under the condition of socialism market economy.
