The Protective Status Quo and Rules Rebuilding of Accusers in China

举报制度在反腐败斗争中有着举足轻重的作用。但在向司法机关进行举报后,一部分举报人却屡遭打击报复。对举报人重奖励而轻保护,对打击报复者重惩罚而轻预防是打击报复举报人案件屡屡发生的结症所在。完善举报立法,扩大对举报人的保护范围,补偿因举报而造成的损失,明确举报人保护机构,规范保护程序是举报人保护制度重构的重要途径。

The rule about accusation plays a very important rule in anti-corruption. However, Some accusers are bowled after accusation. To accusers, the judicial office always pays more attention to rewards and less attention to protection; while, to the person who retaliates, it attaches importance to penalties instead of precaution. So that leads to more and more vindictive cases. There are five ways to rebuild the protective system for accusers： Firstly, to perfect the legislation on accusation; secondly, to enlarge the protective range for accusers; thirdly, to recover the damage caused by accusation; fourthly, to make clear the protective organization; Lastly, to standard the protective order.
