行政管理体制改革与行政法治的契合

On the Correspondence of Administrative Management System Reform with Administration by Law

行政管理体制改革必须与行政法治相互结合、同步推进,做到转变政府职能与实现政府职权法定、创新管理方式与规范政府行为、推进改革与拓展个体权利、改革过程与正当法律程序、巩固改革成果与法律创制相结合。完善行政法体系,宜按照确立个体的行政法主体地位、造就有限政府、加强行政内部民主等要求来进行。

The administrative management system reform must be combined with and be pushed forward with the administration by law mutually, and must implement the following targets ： to transmit the government＇s functions and to achieve law - regulating of government＇s power, to innovate the management ways and to regulate government＇s actions, to push forward the reform and to expand the individual＇s rights, to reform the administrative procedure and due legal process, and to combine confirming the a- chievements of the reform and making laws. To consummate the administrative legal system, it is feasible to establish the subjective status for the individual in administrative law, to constitute a limited government, to strengthen the internal administrative democracy and etc.
