Brief Introduction to the Procuratorial System of Japan (Ⅱ)

日本检察厅包括最高检察厅、高等检察厅、地方检察厅和区检察厅四类,其机构设置并非整齐划一,除检察官外,各检察厅还设有总检察长秘书官、检察事务官和检察技官。检察官是“独任制官厅”,其分为总检察长、副总检察长、检察长、检事和副检事五类,实行检察官同一体原则。检察厅法等还规定了法务大臣对检察官的一般性指挥监督权、检察官的任免、检察官的身份保障等制度。

Japanese procuratorial department composes of the Supreme Procuratorate, Superior Procuratorate, Local Procuratorate and District Procuratorate, the organization of which is not unified and there are secretary officials of the prosecutor general, procuratorial affair officials and procuratorial technical officials in the procuratorates besides the prosecutors. The prosecutor is ＂ sole official department＂ , which divides into prosecutor general, vice prosecutor general, chief prosecutor, prosecutor and associate prosecutor, and conforms with the principle of integration of prosecutors. The procuratorial departmeut law provides such provisions as general power of the minister of justice to command and supervise the prosecutor, appoiutment and removal of the prosecutor, safeguard of the status of the prosecutor, and etc.
