An Analysis on the Cause of the Lack of Legal Faith in China

社会公众的法律信仰对中国的法治化进程具有重大影响,而中国社会缺乏普遍信仰法律的传统。社会公众法律信仰缺失的原因中传统因素的作用固然很大,但是,立法、执法、司法等法律运行的各个环节中存在的一些问题,直接影响着公众对法律的认同和信仰。同时,法律移植过程中没有注意到其精神实质和内涵的传承也是一个重要因素。

The legal faith of the public has a great influence to the proceeding of the rule of law in China, while Chinese society lacks the tradition of a common faith in law. Although traditional factors are to blame for this situation to a great extent, the problems in the enforcement of law in legislation, execution, judicature and so on directly affect the public＇ s approval and faith in law. The failure in recognizing the spiritual nature and connotation of law in its transplantation also accounts for the lack of legal faith
