古弹劾式刑事诉讼模式下的权力配置

On the Distribution of the Criminal Jurisdiction in Accusatorial Procedure Mode

以模式研究为基本方法,从刑事司法权对社会关系和当事人诉讼行为的控制跨度以及司法权的强度三个角度,观察弹劾式诉讼模式下刑事司法权配置;从纵向、横向两个维度,以客观效果为着眼点,探讨古弹劾式下刑事司法权的制衡机制。通过对特定阶段上的刑事诉讼权力制度发展状态的研究,揭示刑事诉讼制度发展的因果关系,寻找刑事诉讼制度的发展规律。

Based on mode research, this paper studies the judicial power of criminal proceedings and its balanced working system in ancient impeachment from three aspects： the control of the social relationship; the control of the privy proceedings; and the intensity and the degree in an objectively transverse and longitudinal dimension with the hope that some sound reasons could be found so as to display the inner developing principles.
