交通肇事罪是《刑法》分则规定的一个重要个罪,也是司法实践中的多发犯罪。但不论是在理论上,还是在司法实践中,对本罪基本犯罪构成的认定、肇事后逃逸的理解以及因逃逸致人死亡的把握等诸多方面,都有很大分歧。对这些争议进行深入研究,以期在更大范围内达成共识,有利于司法适用上的统一。

Traffic accident crime is an important individual crime stipulated by the sub provision of Criminal Law, and a multiple crime in judicature practice as well. Meanwhile, divarications are widely existed both theoretically and practically on issues like confirmation of fundamental criminal construction, comprehension of escapement after disturbance, and how to apprehend the deadly escapement. To gain a broader convention by the thorough study on those divarications would benefits a lot on the unification in the applying of Criminal Law.
