摘要
本文以非法证据排除规则的适用为视角,在关注国外理论与立法、司法新动态的基础上,以刑事司法公正实现保障人权的功能为理念,构建符合我国实际的刑事证明的正当程序。
The criminal procedure law has been put into the legislative layout of NPC. The exclusive rules of illegal evidences are the most important aspect of the law. In this article, the author clarifies some theories, focusing on the new trends of theories and experiences in foreign nations, and taking their beneficial experiences for reference, in the hope of helping con struct a justifiable procedure of the exclusive rules of illegal evidences which agrees with the Chinese situation, better protects human rights and ensures judicature justice.
