摘要
公诉裁量权是检察官的一项重要权力,合理行使公诉裁量权对司法实践大有裨益。为了寻求公诉裁量权行使的最佳方案,运用价值分析、比较研究等多种方法对公诉裁量权问题进行探究,指出中国公诉裁量权行使中存在自由余地小、受到限制多等弊端,并提出了三大改进措施。
The free jurisdiction power of public prosecution is an important power for prosecutors. It＇s reasonable use benefits the justice practice. In order to find the best way of applying it, this paper studies it by using value analysis, comparing research, etc. Then author thinks that there is a little freedom but much restriction in the free jurisdiction power of public prosecution in China, and at last suggests three improved measures.
