Selecting a Way to Create Laws for the System of the Finding of Lost Property

有关遗失物拾得制度中的各种法律关系,各国物权法均给予了足够的重视。在我国物权立法中,此制度也是其中的重要组成部分。在分析比较了古罗马法、意大利法、德国法等国家关于遗失物的相关立法规定的基础上,检讨我国该制度的立法现状,阐述了我国遗失物立法可以选择的立法路径。

Laws of real right of many countries attach sufficient importance to the legal relations in the system of the finding of lost property. In the legislation of real right in our country, this system is also an important component part. Based on an analysis and comparison of the regulations concerning the legislation of the finding of lost property in ancient Rome, Italy, Germany, the paper discusses the present condition of legislation of such a system, sets forth ways to be used for the legislation of the finding of lost property.
