摘要
根据《中国民法典草案建议稿》关于事实婚姻的规定,结合我国《婚姻法》和最高人民法院司法解释对事实婚姻问题规定中存在的不够完善的地方及当前我国事实婚姻的现状,参考外国立法,提出关于事实婚姻的立法设想,以期为正在制定的我国民法典提供有价值的参考。
According to the stipulation concerning factual marriage by The Proposal Manuscript of the Chinese Civil Law Draft, the paper puts forward the contemplation of legislation on factual marriage in the hope of providing valuable reference for the drafting of the civil law in China in the light of Marriage Law , the imperfections of the rules concerning factual marriage explained by the Supreme People＇s Court and the current situation of factual marriage in China.
