摘要
公有制企业与非公有制企业劳动关系的契约化在浙江省经历了不同的发展过程,劳动关系发生了从行政到市场、身份到契约、从无序到规范的深刻变化。同时,劳动关系的和谐稳定受到前所未有的挑战,劳动争议案件大幅上扬。本文总结了浙江省在实施劳动合同制度的过程中取得的成就,就劳动合同实施过程中产生的问题及其原因进行了分析,并提出了应对劳资冲突、建立和谐稳定的劳动关系的选择路径。
The development of the labor contract system has gone through different processes respectively in public and private enterprises in Zhejiang province. They have given rise to the transformation - from the administrative control and disorder to the market dominance and rationalization - of the properties of the labor relations. Meanwhile, due to the contract system, the harmoniousness and the stability of labor relation based on the planned economy have been unprecedentedly challenged and the industrial disputes have been on rise dramatically. The author of the article has summed up the achievement during the enforcement of the system of labor contracts, analyzing the serious problems in the labor relation and the reasons and coming up with the reasonable way to deal with the problems and establish a sort of harmonious labor relation.
