论出版者在著作权法民事关系中的“被动性”

On the passivism of publishers in civil relationship of the law of the authors' rights

在著作权民事关系中,作者和出版者之间的关系本是两个平等主体之间的关系。但在著作权司法实践中,法院在处理作者与出版者因出版合同产生的民事纠纷时,总让人感到合同对出版者的约束力大于对作者的约束力,每每让出版者陷入被动而产生不平之感。因此,需要我们探讨这种不平之感产生的原因,从而正确认识出版者在著作权法民事关系中的“被动性”。

In the civil relationship of the law of the authors＇ fights, the relation between the author and the publisher is equal. But in practice ,when the civil litigation between the author and the publisher comes about ,the court often makes the publishers feel unfair. So we should probe into the reason why the publishers often feel unfair,in order to recognize the ＂passivism＂ correctly.
