摘要
VIP制度是近几年新兴的一种营销方式。对其营业行为所带来的法律问题,没有必要制定专门的法律予以解决,可以用现有的合同法中的格式合同和消费者权益保护法来加以调整和规范:在VIP会员尽特殊义务的前提下,可以享受到优惠待遇,但是VIP经营者给予会员的优惠不能建立在以牺牲非会员合法利益的基础之上。
The VIP system has been emerging a marketing way in recent years. To its legal matter which brings for its business behavior, it is not unnecessary to make special law for its formulation. It may be adjusted and formulated through the form contract in the contract law and the consumer rights and interests protection. In case of the VIP member supplying the special duty, they may enjoy the favorable treatment, but the VIP operator gives member's preferential benefit which isn't able to sacrifice the non- member legitimate benefit.
