The Review of Mao Zedong's Human Rights Thoughts in the Legislative and Judicial Practice in the Revolutionary Base Areas and the Liberated Areas

土地革命时期、抗日战争时期和解放战争时期毛泽东主导的根据地和解放区的立法司法实践,体现了毛泽东人权思想的丰富内容。毛泽东人权思想既包含国家主权、民族自决权等集体人权,又包含民主政治、人身、财产、劳动就业、婚姻自主权及获得国家赔偿、社会福利、社会救助权和迁徙自由权等个体人权。这些内容,对我们今天正在进行的以人为本的社会主义和谐社会建设有很强的现实意义。

Mao Zedong＇s human rights thoughts can be divided into the following three parts： collective human rights, individual human rights and democratic political rights, which are the rich content of Mao Zedong＇s human rights thoughts reflected in the legislative and judicial practice guided by Mao Zedong in the revolutionary base areas and the liberated areas during the Second Revolutionary Civil War, the War of Resistance against Japan, and the War of Liberation. Of the collective human rights, people can enjoy the rights of sovereign state, self-determination, revolutionizing, striking, self-defending and organizing labor union. Of the individual human rights, people may have the rights of living, property, equality, freedom, being employed, being educated, being compensated, rest, medicine, free marriage, beliefs, residing, migrating, receiving social welfare and succor. Of the democratic political rights, people can use the rights of being voted, freedom of speech or assembly and association, holding a demonstration, complaining, suggesting, recalling, building up a new system, etc. These human rights thoughts are both of great value for us to study Mao＇s theory about the construction of Chinese base area and Chinese political power, and of great significance for us to maintain and develop a fundamental human rights, to realize a human-centered, well-being, socialist and harmonious society as well.
