摘要
事业单位劳动关系是我国劳动关系的重要组成部分。由于传统计划经济的影响,事业单位劳动关系存在着计划性、固定性、单一性、行政性等特点。随着事业单位人事制度改革,事业单位劳动关系将发生重大变化,如劳动关系主体多元化、利益明晰化、建立合同化、运行市场化、调整法制化、矛盾显性化等。针对这些变化,工会应积极参与事业单位劳动关系调整,要帮助、指导职工与事业单位签订劳动合同,代表职工与事业单位签订集体合同,建立健全职工代表大会制度,开展素质工程,提高职工就业和发展能力,监督劳动法律法规的执行,并妥善处理好劳动争议。
The labor relationship in institution is an essential element in the labor relationship of our country. Due to the impact of the traditional planning economy, the labor relationship has many features, such as having plan, being fixed, being single and administration as well. Along with the reform of the personnel system in public institution, the labor relationship will face great changes, including labor relationship of the main body being multiple, benefit being evident, the contract being adopted, the operation being marketized, adjustment being under law, contradiction being obvious and so on. Accordingly, labor union should help and instruct laborers sign their labor contracts on behalf of themselves. Moreover, labor union has the duty to es- tablish the laborer's congress system, start quality project, supervise the execution of labor laws and regulations and solve the labor disputes properly.
