Realizing Justice: Abolishment of Death Penalty in Property Crime——On the Tolerance of Criminal Law

根据刑法的谦抑性,从刑罚的报应主义和功利主义的不同角度,对以经济利益为目的,没有涉及到人身权利的财产型犯罪,包括经济犯罪、侵犯财产犯罪、贪污贿赂犯罪的死刑不符合刑罚的价值及谦抑性要求,应当废除。

This article discusses the abolishment of death penalty in the types of economic-benefit-oriented property crimes without involving personal rights, such as economic crimes, crimes against property and crimes of corruption and bribery from the perspective of retribution and benthamism and draws a conclusion that death penalty is not suitable for such kind of property crimes and shall be abolished.
