Analysis on the Attribution of the Infringement of Intellectual Property Rights

知识产权侵权责任归责原则,主要存在三种学说:过错责任说,无过错责任说以及混合学说,本文从民法理论角度对混合学说、无过错责任说进行辨析,澄清理论分歧,并提出相应的建议。

There are three theories about infringement liability attribution of intellectual property fights： the theory of fault liability, the theory of no-fault liability, and the integrated theory. Firstly, this paper analyzes the differences between the integrated theory and the theory of no-fault liability in the civil law system and the common law system, and proposes some countermeasures and suggestions.
