完善我国《村民委员会组织法》刍议

On Legislative Amendment of the Law of Organization of Villager Committee of the P.R. of China

本文从村民委员会定位、村民会议的地位、民主选举的操作性、民主监督的形式以及侵犯自治权利的法律责任及其救济途径五个方面对《村民委员会组织法》的立法缺陷进行了分析,并提出了相应的完善建议,以期对我国村民自治制度的成熟和发展有所裨益。

Since the law of Organization of Villager Committee of the Peoples Republic of China was promulgated and implemented, the self-governance among villagers of China has begun entering steadily a period with a clear legal basis and perfect system. But at the time we are aware of its positive roles we should also make a fair and just legislative appraisal on it and put forward amendment ideas. The paper brings forward some legislative amendment and supplementary suggestions from five aspects.
