行业组织的行政主体资格探讨

The discussion on industrial associations' becoming administrative subject

行业组织的权力来源及权力属性,使行业组织成为一定范围内公共利益的聚合体,并具有相应的公共行政职能,理应具备行政主体资格。而现行体制下多数行业组织行政主体资格的缺失,使行业组织及其会员的权利救济难以得到保障。为此,应重新构建我国行业组织的行政主体地位。

With an analysis of the origin of the industrial association＇s power and nature, we can safely draw the conclusion that the industrial association is the polymer of public interests within a certain scope and correspondingly fulfils the function of public administration. It should be qualified as an administrative subject, however, most industrial associations do not have corresponding administrative subject qualification under the current administrative system, partly causing the absence of the legal status of industrial associations as administrative subject, without guaranteeing industrial associations and their members＇ rights. So the industrial associations＇ status in the administrative law system should be redesigned.
