摘要
提出了地下建筑物权的概念,即地下建筑的权利人,依法对地表以下一定范围建筑所享有的所有权、用益物权和担保物权。分析了地下建筑物权产生的社会物质条件和理论基础及其法律特质。针对我国地下建筑物权的法律制度尚未建立的实际情况,就地下建筑物权的法律基础、地下建筑物权的登记、土地使用权人对地下建筑开发利用的优先权以及已建成的国有地下建筑物利用的优先权等相关法律问题提出了构想。
Followed the development of the human being, the scope of the exploitation of land is growing. The real right of the underground building come with the tide of fashion. The concept of the real right of the underground building is presented. So the obligee seizin the ownership, usufructuary rights and security rights of the underground building. Analysis the social material conditions, the theoretical basis and the legal peculiarity of the underground building. In accordance with the practical situation of the jus of the underground building is not established, the law tentative ideas about the legal base of the real right of the underground building , enrolling the real right of the underground building; the man who has the land use rights, having the priority rights of the exploitation of the underground buiding and the utilization of the built national underground building are presented.
