委托行政执法的普遍采用,固然有利于提高行政执法效率;但另一方面由于规范缺陷,委托行政行为也陷入行为草率、程序违规、对象错误、监管不力、有权无责的现实困境。因此,以提高执法效率、规范执法行为为目的,围绕着厘定概念、明确要件、固化位阶、规范内容和严格管理等五方面,从行政执法实践角度完善委托行政执法制度是当务之急。

Universally adoption of entrusted administrative law enforcement surely can improve the efficiency of administrative law enforcement. However, entrusted administrative law enforcement, due to its drawbacks, has got into a dilemma with the characteristics of carelessness, procedure violation, object incorrect ion, supervision insufficiency and power without obligations. As a result, it is deemed to be extremely urgent to perfect the system of entrusted administrative law enforcement with the purposes of enhancing the efficiency and normalizing the acts of law enforcement, and from the perspectives of redefining, clarifying essentials, order arrangement, regulating content, and strengthening administration.
