解读民办教育的立法规制

On the Legislative Control of Privately-owned Education

随着新时期科教兴国战略的深入人心,我国民办教育理念扭转更新,民办教育事业发展之势蓬勃而来,民办教育立法工作也迎来了发展的春天。但民办教育在进一步壮大的过程中遭遇到了种种制约,重要原因在于其尚未合理地融入法律整体体系,缺乏应有的法律规制和引导。对20世纪80年代以来我国民办教育立法的过程进行了回顾和探讨,并由此对完善民办教育法律体系提出了自己的思考,力图为促进民办教育事业而增加法律动力和法律保障。

When the policy of making the country strong through science and education expands its influence, our idea about privately - owned education has changed. And privately - owned education also gets amazing improvement, which makes the legislation work get into a growing spring. However, during such a procession there are a lot of difficulties that the privately -owned education need to face. The most important reason is that the related legislation has not been melted in the whole legislation system perfectly. Then this course lacks rules and guides which it deserves. This paper gives a review and discussion to the legislation on privately - owned education from 1980s. Then it puts forward an idea on how to perfect the legislation system. It aims to improve the privately - owned education by law power.
