摘要
旨在对奥斯丁法律命令理论做一个比较完整的概括,抽取奥斯丁命令概念的若干要素,在此基础上,阐述哈特等人对奥斯丁命令概念的批判,进而分析哈特批判的限度以及由这些批判可能引申出来的更为基本的某些问题。
This article is aiming at giving a comprehensive understanding of Austin＇s command theory and discussing several elements of Austin＇s command concept. The effective critical comment on Austin＇s command concept has been made by Hart. Limitation of Hart＇s criticism and other basic issues are also analyzed in the article.
