摘要
作为一种新型合同,移动电信服务合同具有技术性、格式性、产业性、垄断性、继续性等特征。这些特殊性导致了电信服务合同中存在着形形色色的侵犯消费者利益的行为。完善电信业立法,破除行业垄断,建立独立有效的服务监管机构,设立便利的纠纷解决机制,强化纠纷处理结果的推广是解决当下移动电信服务合同纠纷的根本出路。
As a new kind contract, the movable telecommunication service contract possesses technicality, formality, industry and monopoly. Such characters bring out a serials behavior which violate the interests of the consumer. Improve the legislation of telecommunication, abolish the trades monopoly, establish the dependent supervisory institution, set up a convenient dispute-solve-mechanism is the cardinal outlet to overcome the above issues.
