故意犯罪是一个不断演进的过程,犯罪预备并非起始,犯罪往往开始于犯意形成以后,正确地理解犯意表示和阴谋,有助于我们认定犯罪预备。鉴于犯意表示和阴谋存在诸多差异,我国司法制度中应确立阴谋犯制度。
