金融控股公司监管的国际实践及启示

International Supervision Practices against Financial Holding Company and Their Enlightenment

本文分析了美国、英国、日本及韩国金融控股公司监管的实践,并在借鉴国际经验的基础上,提出了对我国金融控股公司监管的启示:在坚持分业监管原则的同时,分阶段实现功能性综合统一监管;抓紧制定《金融控股公司法》及其配套法规;建立逐渐递进的金融监管协调机制;实行从机构监管为主转向功能监管;强调外部监管与内部自律的结合;加强对监管者的再监管。

On the base of analyzing supervision practice of financial holding companies in America, British, Japan, South Korea and China＇s Taiwan, and referring international experience, the paper discusses the problems such as the practice of segmented supervision while realizing phased overall supervision, urging its legislation, to establish gradually coordinative mechanism, to implement functional supervision instead of institutional one, to combine external supervision and self-disciple, to supervise the supervisors.
