论我国假释制度的适用及完善——以法律监督为视角

The Application of China's Parole System and Its Perfection

我国目前关于假释制度特别是在监督方面的诸多不科学规定及不当适用,不仅极大地影响了假释功能的发挥,也影响了司法进程和法制发展进程。笔者以假释的法律监督为视角,对当前假释制度监督适用上的存在缺陷和弊端进行分析,提出了改良措施。具体包括加强检察监督,完善假释决定程序;设立专门的释后监督管理机关,落实对假释人员的监督执行。
