论20世纪30—40年代陕西地区的高等法律教育——以西北大学为中心的初步考察

Legal education of Shaanxi in 1930s～1940s

以往学界普遍认为,20世纪上半叶中国的高等法律教育呈现“南东吴,北朝阳”的格局。然而此观点忽视了当时陕西地区以西北大学为中心的高等法律教育繁荣发展的史实。为了弥补学界对民国时期陕西乃至整个西部地区高等法律教育研究的不足,通过对西北大学高等法律教育、法学研究的考察和分析,认为20世纪30—40年代,诸多法学界的名宿硕儒云集三秦,研究著述极其丰富,不仅繁荣了民国时期的法学研究,也为西北地区乃至全国的法律行业提供了专门人才。而陕甘宁边区高等法律教育所培养的人才,为新中国司法系统的建立和发展做出了巨大贡献。

The traditional theory of legal education in China neglected what had happened in Shaanxi in 1930s- 1940s. From 1930s to 1940s, with Northwest University as its center, Shaanxi＇s legal education was very prosper- ous. After reviewing and analyzing the legal education of Northwest University, we came to the conclusion that large numbers of famous scholars of law had been in Shaanxi and lots of works on jurisprudence in 1930s-1940s. The legal education of Shaanxi had contributed a lot not only to the cultivating of legal exporters but also to the development of judicial practice before and after the founding of the P.R. of China.
