摘要
竞业限制是企业运用法律手段保护自己的科技成果免受侵害、避免因员工跳槽后泄露企业关键技术或商业秘密给公司带来经济损失的重要手段。针对我国实施竞业限制的现状,从竞业限制对象,不竞争津贴的发放,竞业限制的年限、范围等方面提出了完善竞业限制的建议,使其既能保护企业在知识产权上享有正当权益,又能使这种保护不以非法损害劳动者的择业自由和劳动力正常流动为代价。
Non - competition is being used to protect the scientific achievement by the company, and it can also avoid the business secrets being dismissed. For the implement of the non - competition oin our county, we give some suggestions about the non - competition from some aspect, such as the objective , the giving out subsidy of the non - competition, the period and the range of the non - competition. Our aim is to make non - competition both protect enterproise enjoying legitimate fights and interests on intellectual property fights, and protect labors the freedom of choosing a job and their regulat illegal flow.
