国家利益观念的演进与二战后国际经济法的发展

The Evolution of the Conception of National Interests and the Development of International Economic Law after World War Ⅱ

国际法与国际关系之间关系紧密,国际法学与国际关系理论的研究相互影响,这些特性决定了不同时期占据主流的国际关系理论的核心概念对国际经济法的发展可能产生迥异影响,或具有不同的解释功能。国家利益的观念即是其一。具体的讲,二战后现实主义的“权力利益观”对同一时期国际经济法的发展产生很大的消极影响,而新自由制度主义的“合作利益观”解释国家间在经济领域的立法合作。同时,在全球化背景下兴起的建构主义的“观念利益观”,无论是在理论还是实践上,对国际经济法的发展都将产生一定程度的积极意义。

International relations is closely related to international law, thus the research in these two disciplines also interrelate. This interrelation reveals thatthe core conceptions of international relations in different stages influenced the development of international economic law in different ways or provided various interpretations for international economic law. One of these conceptions is national interests. Specifically, the interests defined as power insisted by realism influence negatively on the international economic law of that time. The interests defined as cooperation insisted by neo- liberalism advance the legislative cooperation in economic field between countries. In the same time, the interests defined as conception insisted by constructivism against the backdrop of globalization will influence the international economic law positively to a certain extent in theory and practice.
