On the Judgment of Social Harmfulness

新型双层模式是作者在对我国现有犯罪构成模式进行改造的基础上形成的,保留了原有的犯罪构成四要件作为评价的第一层次,社会危害性的现实评价作为第二层次的要件。应认识到社会危害性自身模糊性的相对性,借鉴期待可能性、可罚的违法性和可罚性理论及社会相当性理论将为现实的社会危害性评价提供理论上的依据。

The new kind of two levels of establishing criminal mode is based on the reconstruction of the existing system of constitutions of crimes of our country, in which the four elements for establishing crimes is kept for flint level judgment and the actual social harmfulness judgment for the second level. It is proposed that people should realize the relative illegibility of social harmfulness and take the theories of expected possibility, penal illegality and penalty, and social suitability as theoretical reference in the judgment of actual social harmfulness.
