Externality:Theory,Dealing and Extension——Inspecting the Externalities of the Economic Law

经济法的外部性与经济法的影响有共通之处,是指经济法的制定与实施活动对与此活动无关的第三人利益的影响。经济法主体的特殊性使经济法的外部效应变得难以避免,只能通过寻求法内措施与法外途径的结合来最大限度地减少其产生或弥补其后果。通过对经济法外部性的分析可以发现,外部性问题可能普遍存在于法的大部分领域。

Externalities of the economic law have common sense with influence of the economic law in which enacting and enforcing the economic law brings unexpected costs or benefits to the third. As subjects of the economic law are specialized, externalities of the economic law become unavoidable. However, we can try our best in internalizing externalities by finding legal ways and other method out of the law. And analyzing externalities of the economic law makes us know that it is possible that most of the law have their externalities.
