Probing into Issues Related to Colours Claimed in Design Patent

现行规定和主要观点 外观设计专利请求保护色彩的相关规定见之於《专利法实施细则）（以下简称《细则》）第27条和第28条。《细则》第27条第2款规定：同时请求保誊色彩的外观设计专利申请，应当提交彩色图片或者照片一式两份；《细则》第28条第2款规定：外观设计的简要说明应当写明使用该外观设计的产品的设计要点、请求保证色彩、省略视图等情况。《审查指南》在此基础上作了进一步详细规定。

1. Current provisions and main views The provisions concerning colours claimed in design patent are set forth in Rules 27 and 28 of the Implementing Regulations of the Patent Law （the Implementing Regulations for short）. Rule 27, paragraph two of the Implementing Regulations provides that ＂where an application for a patent for design seeking concurrent protection of colours is filed, a drawing or photograph in colour shall be submitted in two copies＂; Rule 28, paragraph two of the Implementing Regulations provides that ＂the brief explanation of the design shall include the essential portion of the design, the colours for which protection is sought and the omission of the view of the product incorporating the design＂. On the basis of these provisions, the Guidelines for Examination have set forth further detailed provisions.
