我国刑法学界对于犯罪特征的争论比较激烈,但对于什么是犯罪特征却缺乏深入的研究。犯罪特征是犯罪本质的外化,是犯罪区别与其它社会现象的外在表象,在犯罪与其它社会现象的关系中得到表现。犯罪具有三个基本特征,其中社会危害性不是犯罪的本质特征,也不是犯罪的本质,而是犯罪的社会特征;刑事违法性是犯罪的法律特征;应受刑罚惩罚性是犯罪的责任特征。它们三者之间是横向并列关系,不存在谁决定谁。
