一项合理有效的养老保险制度需要有一套健全完善的法律体系作保障。我国养老保险法制化进程中取得的成绩是值得肯定的,但也存在着明显的缺陷和不足。在人口老龄化高峰到来之际,如何走出一条适合中国国情的养老保险之路,已成为我国养老保险制度改革中一个比较突出的问题。基于这种考虑,在回顾我国养老保险立法化进程的基础上,对我国养老保险制度的立法现状和对策进行尝试性的研究,希望能为完善我国的养老保险制度提供一点可供参考的东西。

A reasonable and effective endowment insurance system needs a sound and perfect law setup to ensure. It is certain that our country has achieved a lot and has made great progress in the process of endowment insurance legal system. However, the drawback and shortcomings are obvious to exist in. As the old-age are increasing and will reach the peak , how to step on to a way of fitting in with national conditions endowment insurance system has became a striking problem nowadays. In this case, this article is based on looking back the process of our country＇s endowment insurance legal system, mainly making a study on our present situation and policy of endowment insurance system, hoping to provide somethiug useful for improving our country＇s endowment insuronce.
