试论“过期罚款”的废止

Short Comment on the Abolishment of Imposing a Fine after the Permitted Date

图书馆长期实行的“过期罚款”制度由于其不具备罚款的主体资格,欠缺法律依据,并且违背了图书馆的平等精神,应予废止。对读者的过期行为应采用过期限权来处罚,并利用诚信制度进行规范。

The system of imposing a fine after the permitted date, which has been practicing in the past time in the library, should be abolished. For library is short of legal basis, violates the library spirit of equality and does not have qualification for imposing a fine. Library should limit the readers＇ right when they exceed the time of returning borrowing books, and restrain this phenomenon by using the institution of honesty and reputation.
