Folk Rules as Source of Legal Decisions:A Judicature-centered Perspective

由于受立法中心传统的影响,人们往往把法官的裁判渊源局限于国家法。而在司法实践中民间规则作为裁判渊源,已被广泛运用。因此,要承认民间规则的法源地位,研究立场必须从立法中心向司法中心转换,必须从法官裁判的可接受性理解民间规则的司法化。

Owing to the effect of the tradition of legislation, national law is often considered to be the only source of legal decisions. However, folk rules have often been resorted to in judiciary practice. If we acknowledge that folk law may be considered to be one of the sources of law, we need to shift our perspectives from legislation-centeredness to judicature, and to understand folk law in the terms of its acceptability.
