我国风能资源开发利用与保护立法问题及完善

Problems and improvement on legislation of the wind resources development and utilization and protection in China

为了合理地开发利用风能资源,加强对风能资源生态价值的保护,通过综合研究我国风能资源开发利用与保护的现行立法,对比国外先进的法律制度,结合环境与资源保护法学领域的最新理念与观点,运用资源生态学与生态经济学的方法,提出有必要制定一部气候资源法,确立风能资源开发利用与保护的基本原则与基本制度,建立风能资源管理体制,最终保证风能资源开发利用活动的可持续发展。

The purpose of this thesis is to regulate the actions on the development and utilization of the wind resources, and then emphasize the importance of protecting its ecological value. The author has studied legislation of the wind resources in our country and in developed countries with new ideas in Environment Law and scientific methods of the resources economics and the re- sources ecology. Finally, the athour thinks that it is necessary to legislate the Climate Resources Law to ensure sustainable development of the wind resources.
