摘要
文章在对矿产资源所有权、探矿权和采矿权进行详细分析论述的基础上，提出探矿权、采矿权的取得要与矿产资源所有权的具体权能的分离、出让、赋予有机地结合起来，＂两权＂的取得既是＂行政行为＂，也是＂经济行为＂。
Based on the detailed analyses of the ownership, exploration right and prospecting right on geology and mineral resources,the paper points out that to get exploration right and prospecting right on geological and mineral resources should be organically combined with the ownership separation,transfer and assignment.To have these'Two Rights'is an administrative action,on one hand and on the other hand,it is also an economic action.
