借鉴欧美经验制定中国天然气法律

CHINESE LAW ON NATURAL GAS TO BE LEGISLATED BY EXPERIENCES FROM EURAMERICAN COUNTRIES

中国天然气行业发展迅速,但相应的立法进展缓慢。应借鉴欧美发达国家的立法经验,结合中国天然气法律体系现状与行业特点,加快天然气立法。为此,围绕促进中国天然气立法这一主题,从3个方面进行了论述分析:首先,分析中国天然气行业法律体系现状,指出现有法律体系层次较低、多个领域存在空白和管理体制不完善等问题;其次,有针对性地对欧美国家在天然气自然垄断领域、非自然垄断领域以及现代监管体系建立等3个方面的一般性经验进行总结,并得出一些启示;最后,基于中国天然气法律体系和行业实际情况,提出制定天然气法律应包括以下内容:加强天然气中、下游的监管,建立竞争性天然气批发市场,规范天然气行业管理体系等。

Natural gas industry develops rapidly in nowadays China whereas the corresponding legislation for it is still in low process. Based on the present situation of Chinese gas legal system and the specialities on gas industry, China should speed up its legislation process for gas industry by learning universal experiences from Euramerican countries. How to drive gas legislation to keep pace with the development of gas industry have been discussed and analyzed from three aspects as follows: firstly, the status quo of gas law system in China is still in primary-level process with blank in many areas and incomplete administration; secondly, some enlightenments have been obtained by summarizing up the run-of-mill experiences from Euramerican countries, including natural monopoly sector, non-natural monopoly sector, and the establishement of modern regulation system; finally, combining the current situation of gas industry and Chinese gas legal system, it is put forward that Chinese gas legislation should include these contents as follows: to strengthen the supervision of natural monopoly sector both for the upstream and the downstream of gas industry, to set up competitive gas wholesale market, and to regulate gas industry management system, and so on.
