On the Validity Restriction of the Victim Consent

在美国侵权法中,受害人同意是被告针对原告提起的故意侵权〔1〕诉讼可以主张的抗辩事由之一。受害人同意是被告针对原告提起的故意侵权诉讼所主张的抗辩事由。被告的抗辩得到法庭支持,必须以同意的有效成立为前提。同意的效力一般会受到同意的能力、同意的范围、同意的基础、同意的内容等因素的影响。

In American torts law the victim consent is one of the protest causes which may be argued by the defendant against the intentional torts litigation. The victim consent is the protest excuse against the plaintiff＇s claim of intentional torts, and the admissible precondition of defendant＇s argument shall be the validity of the consent. The validity of victim consent may be generally influenced by several factors such as the capacity, extension, foundation and content of the consent.
