摘要
从法与经济学角度对强制工程质量保险制度进行深入分析,能够帮助立法机构和政府决策者认清该制度的本质,使得工程质量管理制度达到其经济目标和社会公平目标,建设符合经济效率兼顾社会公平的强制工程质量保险制度,促使工程质量事故总成本最小化,保证在实现赔偿目标(公平目标)的同时有效控制工程质量(经济目标)。
Deeply analyzing Compulsory Inherent Defects Insurance against Buildings System（CIDIBS） from law and economics angles can help legislators and government decision makers to get essence of the System, and to establish the CIDIBS that accord with economic efficiency as well as social justice. It can help for the total cost minimization control and high construction quality and achieving compensation purpose at the same time.
