Development of U.S.A. Public Defamation Law and the Extension of Freedom of Speech

本文以美国大众传播中的公共诽谤问题为主要研究对象,考察美国的公共诽谤法在不同历史阶段的发展状况,以及它们所代表的社会价值、政治制度和法律理念,重点考察现代司法系统如何在民主宪政的理念下协调公共官员(公众人物)的名誉权和新闻媒介的言论自由权之间的冲突。

This paper studies the public defamation law of the United States, the development of the public defamation in each historical stage, and the social value, political system and legal concepts it represents, and analyzes how the judicial system settled the conflicts between the public officials＇ （public figures） right of fame and the mass media＇ s freedom of speech under the concept of democratic constitutional government.
