摘要
婚姻法中新增设的探望权制度,有其积极作用,但在保护子女利益方面还需完善,本文提出在坚持以保护子女利益为核心的立法宗旨的基础上,应赋予子女探望权的主体资格,子女对探望权的行使具有选择权,在一定情况下,子女有权拒绝父母的探望,而父母却不能自动抛弃其探望权。
Based on the related regulations of China and the facts of other countries concerning legislation on visitation right, this article offers a dialectical, rational, and pragmatic analysis of China＇s visitation right from the legislative purposes on the subjects of the visitation right, the abandonment of the right by the parents, and the rejection of the visitation right by the children.
