论土地空间的产权分离开发模式

Discussion on Exploitation Mode of Property Right Separation of Land Space

通过对我国土地空间的相关法律滞后于当前土地空间的开发利用的现状进行分析,提出了土地空间的产权分离开发模式。结果表明,根据土地空间的“区位性”和土地空间的使用权可分离性进行开发,具有降低开发风险,优化土地资源配置和提高土地空间的利用率等特点,是缓解当前用地紧张的有效途径之一。

The purpose of this paper was to seek effective approach which alleviated the intensity of current land use, aiming at the contradiction between increasing scarcity of land resource and low efficiency of land use, The actuality that the law involved land space lagged behind current exploitation was analyzed. New exploitation mode of property right separation was put forward. The new mode pointed out that exploitation should based on land special location and the special separability of the land use right, which reduced exploitation risk, optimized land resource allocation and improved land space use rate. The new mode was an effective way to reduce the intensity of land use.
