餐饮企业商标被恶意抢注的法律保护

Legal Proiection against Malicious Preemplive Registration Regarding Trademarks of the Catering Enterprises

“恶意抢注”是指：以获利为目的、用不正当手段抢先注册他人在该领域或相关领域中已经使用并有一定影响的商标、域名或商号等权利的行为。近些年来，随着餐饮行业的不断发展，有些餐饮企业的规模迅速扩大，而有关餐饮企业商标在我国和国际上被大规模恶意抢注的现象却屡见不鲜，商标成为了最容易被侵犯的对象之一。恶意抢注产生了诸多法律问题，对餐饮企业危害是巨大的，严重损害了餐饮企业的合法权益。本文就我国餐饮企业如何免受恶意抢注的侵害，通过何种途径保护企业的商标进行了分析。

＂Malicious preemptive registration＂ refers to a kind of action which preemptively registers the established trademarks, domain names or trade names within the certain or related field through the unfair means for the sake of profits. Malicious preemptive registration brings many legal issues, which greatly infringe the legal rights and interests of the catering enterprises. This article dis- cusses some effective approaches on avoiding loss of the Chinese catering enterprises caused by malicious preemptive registration.
