秦代军事犯罪考论

An Inquiry into the Military Transgressions of the Qin Dynasty

所谓“军事犯罪”,包括反叛通敌、作乱、不上宿、破坏作战秩序、损坏军用物资设备、违反国家兵役制度和军功赏罚规定等等。秦代对于这些军事犯罪行为制定了严格的犯罪界定和惩治办法,并且通过严惩这些军事犯罪行为,防止和减少了对国家军事利益的损害,保证了军队的战斗力和对敌作战的胜利。

The ＂military transgressions＂ during the Qin Dynasty fall into a number of categories, namely, rebellion and collaboration with enemies, insurrection, failings in guard and defese duties, breaching military orders, sabotaging military facilities, vi regulations concerning military exploits, olating the military services, and disregarding reward and punishment etc. These crimes have well-defined applicabilities and corresponding punishments are meted out. Through these hard and fast measures against military transgressions, the Qin government successfully curbs and decreases the amount of military trespasses, a sure guarantee of battle effectiveness and military victories.
